Smritivan — a product of Navigo Software Solutions

These Terms of Service ("Terms") govern access to and use of Smritivan (the "Service"), provided by Navigo Software Solutions ("Company", "we", "us", or "our"). These Terms supplement, and should be read together with, the Company's general Terms and Conditions and the Smritivan Privacy Policy; in the event of a conflict specific to Smritivan, these Terms control.
Smritivan is used by three kinds of participants: Studios (photography businesses that register as paying customers), Couples (who receive a private wedding or event album), and Guests (who view an album via a time-limited share link without an account). References to "you" apply to whichever role you hold; where a provision applies to only one role, that is stated explicitly.
By creating a Studio or Couple account, or by accessing a shared album as a Guest, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Smritivan is a wedding and event photo hosting and studio management platform, providing:
We may modify, add to, or discontinue features of the Service at any time, and will make reasonable efforts to notify affected Studios or Couples of material changes to core functionality.
A Studio registers using an email and password, and is responsible for its account credentials, the accuracy of its business/portfolio information, and all activity under its account, including photo uploads made on its behalf.
A Couple's album is accessed using the phone numbers of the bride and groom. The Couple is responsible for keeping these phone numbers, and any device they use to access the account, secure. If a Couple loses access to the phone number(s) used for sign-in, contact us at support@navigosoftwares.com for account recovery.
Guests do not create an account. Access to an album via a share link is time-limited as configured by the Couple, and may be revoked or may expire at any time. The Company is not responsible for a Guest's inability to access an album after a link has expired or been revoked.
Studio and Couple accounts must be created by individuals at least 18 years old and capable of forming a binding contract.
We may suspend or restrict access to a Studio or Couple account if we reasonably suspect fraud, abuse, a security risk, unauthorized content, or a violation of these Terms, pending investigation.

As the party uploading wedding or event photos, the Studio is solely responsible for ensuring it has obtained all consents necessary — from the Couple and, where required by applicable law, other individuals depicted, including at events where minors are present — before uploading photos to the Service. This includes consent for the face-detection/face-search processing described in the Privacy Policy. We reserve the right to investigate and take appropriate action against anyone who violates this section, including suspending or terminating access and/or removing content.
Studios pay the Company to create a new wedding or event album, choosing between three plans:
Prices may change at any time with reasonable notice, as reflected on the album-creation screen at the time of purchase. Payment is processed via Razorpay Checkout (UPI, cards, netbanking, or wallets). Certain Studio accounts may be designated by the Company as payment-exempt for internal or promotional purposes.
A Studio may upgrade an existing album on the Lite or Standard plan to the Extended plan, paying the then-current difference between the album's current plan and the Extended plan's price via Razorpay Checkout. Plan changes are one-directional and always move toward Extended — the Service does not currently support downgrading an album back to a lower-priced plan.
Each wedding or event album includes 1 year of included hosting. After this period, continued hosting requires a renewal payment — currently ₹799/year for a Lite-plan album, ₹1,199/year for a Standard-plan album, and ₹1,799/year for an Extended-plan album (subject to change with notice). Renewal is currently handled manually: our team contacts the Couple directly to explain the renewal and arrange payment. If a Couple does not renew, the album moves to a frozen, read-only state — it is not deleted.
A share of each Couple's renewal payment is credited to the relevant Studio's wallet and paid out to the Studio's nominated UPI ID or bank account. Studios are responsible for providing accurate payout details; the Company is not responsible for funds sent to a valid but incorrect account resulting from inaccurate details provided by the Studio.
Where the Company offers a Studio a discount off the listed price of a new album, the Studio's dashboard lets the Studio generate and share with its Couple client a "bill" reflecting the original, pre-discount amount, alongside a separate "receipt" reflecting the actual amount paid to the Company, for the Studio's own records. The Company is not a party to, and assumes no responsibility for, any amount a Studio represents to or charges its Couple client that differs from what the Studio actually paid the Company.
All fees are exclusive of applicable taxes (e.g., GST) unless stated otherwise; each party is responsible for its own applicable tax obligations.
All rights, title, and interest in and to the Service — including the Smritivan platform, its software, the face-search technology, and all Company branding — are and remain the exclusive property of the Company or its licensors.
We grant Studios and Couples a limited, non-exclusive, non-transferable, revocable license to access and use the Service for hosting, viewing, and sharing wedding or event photos as contemplated by these Terms.
The Studio and/or Couple retain whatever ownership or license rights in the uploaded wedding or event photos they held before uploading to the Service. We claim no ownership over uploaded photos — we are granted only a limited license to host, process (including face detection), and display the photos as necessary to provide the Service.
Where a Studio opts in to feature specific photos on its public portfolio page or the public Studio directory, the Studio represents that it has the Couple's permission to use those specific photos publicly.
If you provide suggestions or feedback about the Service, we may use it without restriction or obligation to compensate you.

We are not responsible for the availability, accuracy, security, or practices of these third-party services, which are governed by their own terms and privacy policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. THE COMPANY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED [amount paid to us for the relevant album in the 12 months preceding the claim].
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from claims arising out of or in any way connected with:
A Studio may close its account at any time by contacting support; a Couple may stop using the Service at any time. We may suspend or terminate access if a Studio or Couple breaches these Terms, if required by law, or if we discontinue the Service generally.
Access to the Service ends immediately upon termination. Consistent with our "forever storage" model, wedding or event photos are not deleted solely because a Studio account is closed, unless the Couple or another authorized party requests deletion. Provisions that by their nature should survive termination (IP rights, indemnification, limitation of liability, governing law) will survive.
These Terms are governed by and construed in accordance with the laws of India. In the event of any dispute, the parties shall first attempt to resolve the matter amicably. If unresolved within thirty (30) days, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator, seated at Ernakulam, India, conducted in English, and kept confidential. Subject to arbitration, the courts at Ernakulam, India shall have exclusive jurisdiction for interim or injunctive relief.
We may update these Terms from time to time. Material changes will be notified via an in-app notice and/or a website banner, at least 1 day before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Payments made to the Company for new album creation or plan upgrades are generally non-refundable once processed, except where required by applicable law or where the Company, in its discretion, agrees to a refund. Couple renewal payments, being collected manually, are handled case-by-case by our team at the time of renewal. To request a refund, contact us at support@navigosoftwares.com.
The Company is not liable for failure or delay in performance resulting from causes beyond its reasonable control. If any provision of these Terms is found unenforceable, that provision will be limited to the minimum extent necessary and the rest will remain in effect. You may not assign your rights under these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
